Tarver cited "insufficient evidence of intentional disregard or plain indiffference" to OSHA general housekeeping standards in the decision not to charge Imperial with criminal violations. He also said there was no federal criminal statute "specifically addressed to the safety of workers within the sugar industry at the time of the Imperial Sugar explosion."
