Ga. man's claim of speedy trial violation denied

ATLANTA (AP) — The Georgia Supreme Court has dismissed a pretrial appeal by a man who said his constitutional right to a speedy trial had been violated.

Marcin Waldermar Sosniak faces the death penalty in the March 2006 slayings of four people in a Forsyth County farmhouse.

In an opinion published Monday, the court says Sosniak failed to follow the proper procedure in filing his appeal. The high court says its decision overturns its own prior rulings that gave defendants the right to an automatic appeal of a denial of a pretrial constitutional speedy trial claim.

The opinion says that even if Sosniak had followed proper procedure, the trial court carefully evaluated his claims and correctly denied the appeal.

A call to a lawyer for Sosniak was not immediately returned.
